Street work notice

Work in a public area must be notified by the person undertaking the project.
The notification requirement is based on Section 14a of the Maintenance Act.
The notification must be made electronically(Instructions for the applicant) and must be accompanied by the necessary documents(Street work instructions and regulations, Techn. ltk 25 3 2020):
-Study/plan showing the need/importance of the work and the use of the area at the required frequency (excavation area, site area)
-Temporary traffic arrangements during working hours, taking into account all modes of transport
-The person responsible for the work and his or her professional qualifications.
-Location of equipment and structures to be used on site (site plan à location of storage/worksite sheds, service roads, traffic, logistics, etc.)
-Document if the notifier is someone other than the project proponent (owner/holder of the pipeline/structure)
In addition to this, the municipality may require any other information necessary to process the notification.
The municipality shall, on the basis of the notification, issue such regulations for the execution of the work as may be necessary to reduce the potential harm and damage to traffic flow, safety and accessibility, wiring and equipment in the street and public areas, and structures in the street and public areas. There shall be a notice board at the site showing the name of the person carrying out the work and the contact details of the person responsible for the work.
The contractor may implement the traffic arrangements according to the type drawings if they are suitable for the work. If not, the contractor must submit a separate traffic management plan.
The implementation and maintenance of the temporary traffic management is the responsibility of the construction site.
The street owner’s consent to the street work notice is conditional on the landowner’s consent for the wire/pipeline/structure to be constructed.
The time taken to process a notification depends on the size and nature of the project. The project proponent should expect a processing time of 2-3 weeks.
Note: The project may also require permits from the building control or environmental service. It is the responsibility of the project proponent to ascertain the need for these.
Street works charges
For street works, the municipality charges(Maintenance Act § 14 b) a fee for the processing of the notification, a fee for the supervision of the work and a fee for the use of the area.

Appeals
An appeal may be lodged against a municipal decision taken under section 14 of the Maintenance and Cleanliness of Streets and Certain Public Areas Act, a decision taken under section 15 concerning the appointment of a supervisory authority or the delegation of its functions, and a decision taken under section 14b concerning the approval of a charge, in accordance with the provisions of the Local Government Act.
Any other decision taken under this Act may be appealed to the Administrative Court in accordance with the provisions of the Administrative Procedure Act (808/2019).
Before applying for an amendment to the imposition of fees in accordance with § 14b, paragraphs 1-3, the person liable to pay must submit a reminder to the municipal authority deciding on the collection of the fee within 14 days of receiving the fee sticker in writing to the municipal technical committee by e-mail to tekniset(at)siilinjarvi.fi or by delivering it to the technical service department of Siilinjärvi municipality (visiting address Oppipojantie 4) or by post to Siilinjärven kunta, Tekniset palvelut, PL 5, 71801 Siilinjärvi.
A new decision must be taken on the reminder and a new payment slip must be sent to the person liable to pay.
